You need an experienced attorney who can help you during these difficult times. Although time can heal most wounds, there are specific and complicated deadlines which can affect your ability to bring a claim against the party who negligently, carelessly, or recklessly injured you. And despite what they say, the insurance company—not yours, and certainly not the responsible party’s—is not your friend. In these types of cases, neither time nor the insurance company is on your side.

Insurance Bad Faith
When you buy insurance, you expect your insurance company to step in to take care of you during you time of need. Maybe you were in an auto accident and your insurance company is supposed to fix your car; maybe your home has been damaged by hail, and they’re supposed to fix your roof; maybe your basement has been flooded, and the insurance company is supposed to reimburse you for your belongings; or maybe your company is not reimbursing you for (or is refusing your entitlement to) healthcare benefits that you paid for.
Under any of these scenarios, you’ve done your part: You’ve paid your premiums monthly, and you expect to get what you pay for, coverage when you need it. But it doesn’t always happen that way. After all, insurance companies are in the business of making money, not paying it out.
Under Colorado law, insurance companies are obligated to deal with you in good faith; they are required to promptly evaluate your claim and promptly pay your claim if there is no reasonable dispute that you’re entitled to benefits. If the insurance company does not do this, the insurance company may have dealt with your claim in “bad faith” or the company may have been deemed to have unreasonably delayed or denied payment of your claim. In either of those cases, an insurance company may owe its insured (you) up to three times the amount of benefits owed to them, in addition to interest, attorney’s fees, costs, and other potential damages.
If you believe that your insurance claim has been unreasonably delayed or denied, you need an experienced insurance bad faith attorney at Petis Law, LLC who can help position your claim in the most favorable way possible.
Real Estate Law
Whether you’re an individual or a company, whether you’re buying or selling land for the first time or the fifteenth time, whether you’re dealing with the government or private parties, real estate transactions are complex matters. There are tens of thousands of pages of statutes, court decisions, and regulations which affect these matters. The contracts and legal principles involved are dense. You need a knowledgeable Colorado real estate attorney to help you navigate these confusing waters.
The Colorado real estate attorney at Petis Law, LLC can help you with contract interpretation and drafting; with land use matters involving development, water rights, and environmental issues; with residential and commercial leasing and landlord-tenant transactions; homeowners’ associations matters; and more. Whether you need help closing on a $20,000 mobile home unit or drafting the construction contracts for a $2,000,000 project, no matter is too large or too small. Please call Petis Law today for help dealing with your real estate matter.
At Petis Law, we have started our own businesses and nonprofit corporations. We know how exciting and nerve-wracking these experiences can be. That’s why, when you start your own business or nonprofit, you need an attorney who has gone through these trials and tribulations as well, so that you get the personalized attention and understanding you deserve.
The business lawyer at Petis Law, LLC can help you with business formation (creating new corporate entities); as well as drafting, reviewing, and negotiating commercial agreements. Whether you’re starting a business or a 501(c)(3) nonprofit, we can help you by drafting your bylaws, partnership and operating agreements, as well filing the appropriate documents with the state and federal governments.
Choosing the right business entity (whether a limited liability company (“LLC”), a corporation, a partnership, or a professional corporation) can have serious and long term financial, liability, and tax implications. Because of these high stakes, you need a knowledgeable business lawyer who has been there to help guide you through the process, and who can fight with you in the trenches if and when the going gets tough.
Civil Litigation / Litigation Prevention
In litigation, there are winners and losers. It’s as simple as that. You don’t want an attorney to simply “represent” you; you need an attorney who is going to fight to win. An attorney who is as passionate about winning as much as they despise losing. But you also want an attorney who plays by the rules. It is possible to get a fantastic result while still doing the right things, the right way, for the right reason. If that sounds like your kind of attorney, call the trial lawyer at Petis Law, LLC.
In addition to a passionate and zealous litigator, you also need an attorney who has tried cases—an attorney who has gone to the mat for his clients before. The managing partner at Petis Law, LLC has tried numerous jury and bench trials, with nearly all of them resulting in favorable verdicts for his clients. He has also litigated hundreds upon hundreds of cases. Before hiring an attorney to fight for you in the courtroom, you need to ask him or her how many trials he has had.
But while we enjoy being in the courtroom, we understand that most of our clients do not, which is why we strive to position our cases so as to avoid trials if at all possible. We call this “litigation prevention.” Litigation prevention consists of preparing cases, contracts, and agreements in such a way as to minimize the risks of litigation. For cases already in litigation, this principle involves exploring different types of alternative dispute resolution, including settlement discussions, mediation, and sometimes even arbitration.
At the end of the day, if you’re going to be in court, you want an attorney by your side who has been there before, and who enjoys winning. At the same time, if you want to avoid court, you need an attorney who knows why cases end up there in the first place. Either way, and whatever your situation, you should call Petis Law.
